تعارف

یہ بغداد کے علاقے کاظمیہ میں قاضی ابو یوسف رحمۃ اللہ علیہ کی معروف مرکزی قبر اور مسجد ہے، جو وسیع تر روضۂ کاظمین کے احاطے سے متصل واقع ہے۔ تاریخی اور مقامی شواہد اس مدفن کو ابو یوسف یعقوب بن ابراہیم انصاری کوفی رحمۃ اللہ علیہ سے منسوب کرتے ہیں، جو امام ابو حنیفہ رحمۃ اللہ علیہ کے ممتاز ترین شاگرد اور ابتدائی عباسی دور کے بااثر فقہاء میں شمار ہوتے ہیں۔ یہ علامتی مقام نہیں، اس لیے اس اندراج میں ان کی مرکزی سیرت اور بغداد کے مدفن کی تاریخ دونوں شامل ہیں۔

ابو یوسف رحمۃ اللہ علیہ ۱۱۳ھ میں کوفہ میں پیدا ہوئے۔ تراجمی کتابیں ان کے گھر کے محدود وسائل اور علم حاصل کرنے کی شدید خواہش کا ذکر کرتی ہیں۔ خاندانی ذمہ داریوں کے سبب ایک وقت میں ان کی تعلیم رکنے کا اندیشہ پیدا ہوا، اور علمی روایت بیان کرتی ہے کہ امام ابو حنیفہ رحمۃ اللہ علیہ نے مالی مدد کر کے انہیں درس جاری رکھنے کا موقع دیا۔ یہ واقعہ اس حقیقت کا دائمی سبق بن گیا کہ ایک سنجیدہ طالب علم کی مدد آئندہ نسلوں کی علمی تاریخ بدل سکتی ہے۔

ان کے اساتذہ میں ہشام بن عروہ، یحییٰ بن سعید انصاری، عطا بن سائب، اعمش اور دوسرے بڑے محدثین شامل تھے، جبکہ ان کی سب سے طویل اور فیصلہ کن فقہی رفاقت امام ابو حنیفہ رحمۃ اللہ علیہ کے ساتھ رہی۔ ابو یوسف رحمۃ اللہ علیہ نے خود بیان کیا کہ وہ سترہ برس اپنے استاد کے ساتھ رہے۔ اس تربیت نے انہیں حدیث، فقہ، تفسیر، مغازی اور عرب کے تاریخی واقعات پر دسترس دی، اس لیے ان کے علم کو صرف عدالتی عمل تک محدود نہیں کیا جا سکتا۔

انہوں نے کوفہ کے محدثین و فقہاء سے تعلیم پائی اور امام ابو حنیفہ رحمۃ اللہ علیہ کے فقہی طریقے کے سب سے نمایاں ناقل اور ترقی دینے والے بنے۔ ابو یوسف صرف استاد کے اقوال دہرانے والے نہ تھے؛ وہ روایات کا موازنہ، عدالتی حالات کا جائزہ اور دلیل یا عوامی ضرورت کے مطابق بعض مسائل میں مختلف رائے اختیار کرتے تھے۔ ان کی کوششوں سے ابتدائی عراقی فقہی منہج منظم تدریس، عدالت اور کتابی روایت میں منتقل ہوا۔

ان کے شاگردوں اور راویوں میں محمد بن حسن شیبانی، یحییٰ بن معین، امام احمد بن حنبل اور اسد بن فرات شامل تھے۔ محدثین نے انہیں اہلِ رائے کے فقہاء میں سنت اور حدیث کا غیر معمولی طور پر مضبوط ناقل سمجھا؛ یحییٰ بن معین نے ان کی حفظ و روایت کی پختگی بیان کی، اور امام احمد بن حنبل نے اپنی ابتدائی حدیثی تعلیم میں ان کے پاس حاضری کا ذکر کیا۔ منقول دلیل اور منظم فقہی غور کا یہی اجتماع ان کے فیصلوں کو علم اور عملی عدل دونوں سے جوڑتا تھا۔

عباسی دور میں وہ خلیفہ مہدی اور ہادی کے زمانے میں قاضی رہے اور ہارون الرشید کے عہد میں اپنے بلند ترین سرکاری منصب تک پہنچے۔ بعد کی روایت انہیں وسیع طور پر قاضی القضاۃ کے لقب سے یاد کرتی ہے۔ اس منصب نے انہیں علم اور ریاستی اختیار کے سنگم پر کھڑا کیا: وہ قاضیوں کی تقرری، حکمرانوں کی رہنمائی اور مظلوم فریقوں کو ناانصافی سے بچانے کی ذمہ داری رکھتے تھے۔ ان کی زندگی بتاتی ہے کہ سرکاری اقتدار ذاتی امتیاز نہیں بلکہ اللہ کے سامنے جواب دہی ہے۔

ان کی سب سے مشہور تصنیف کتاب الخراج ہے، جو ہارون الرشید کے لیے لکھی گئی اور زمین، محصول، سرکاری آمدنی، اخراجات اور رعایا کے حقوق پر بحث کرتی ہے۔ ابو یوسف رحمۃ اللہ علیہ نے جائز آمدنی کو عدل سے جوڑا، عاملوں کے ظلم سے خبردار کیا اور واضح کیا کہ کسانوں اور محصولات ادا کرنے والوں کو تھکا کر پائیدار خوش حالی پیدا نہیں کی جا سکتی۔ انہوں نے حدیث بھی روایت کی اور فقہی اختلافات و آثار پر کتابیں لکھ کر حنفی فقہ کی تحریری بنیاد مضبوط کی۔

ابو یوسف رحمۃ اللہ علیہ ۱۸۲ھ میں بغداد میں وفات پا گئے اور آخری وقت تک عدالتی خدمت سے وابستہ رہے۔ ان کی قبر کاظمیہ کی مذہبی جغرافیہ کا حصہ بن گئی۔ یہ مقام بڑے روضۂ کاظمین کے قریب ہونے کے باوجود اپنی الگ سنی علمی شناخت رکھتا ہے اور یاد دلاتا ہے کہ بغداد کے مقدس ورثے میں مختلف فقہی اور روحانی روایتوں کے علماء شامل ہیں۔ آخری بیماری کی ایک روایت ان کی علمی تواضع محفوظ کرتی ہے: انہوں نے ہر ایسے فتویٰ سے رجوع کا اظہار کیا جو قرآن، سنت اور مسلمانوں کے اتفاق کے مطابق نہ ہو۔ یہ واقعہ دکھاتا ہے کہ بلند منصب کے باوجود وہ فقہی فیصلے کو وحی کے سامنے جواب دہ سمجھتے تھے۔

اس مزار کا تعلیمی پیغام واضح ہے: علم کے لیے استقامت ضروری ہے، استاد کو قابل طالب علم کی سرپرستی کرنی چاہیے، قاضی کو علم کے ساتھ زندہ ضمیر رکھنا چاہیے اور حکمران کو سچی نصیحت پہنچانا عالم کی ذمہ داری ہے۔ زائر اللہ تعالیٰ سے دعا، مرحوم کے لیے ایصالِ ثواب اور عدل، علم و عوامی خدمت پر غور کے ذریعے اس مقام سے فائدہ اٹھا سکتے ہیں۔


تاریخی / دینی اہمیت

قاضی ابو یوسف رحمۃ اللہ علیہ اسلامی قانون کی تاریخ کے ایک فیصلہ کن مرحلے کی نمائندگی کرتے ہیں۔ انہوں نے امام ابو حنیفہ رحمۃ اللہ علیہ کے علم کو آگے پہنچایا، حنفی فقہ کو تحریری اور عدالتی عمل میں منظم کرنے میں بنیادی کردار ادا کیا اور قاضی القضاۃ کے منصب کو علمی ذمہ داری سے جوڑنے والا نمونہ دیا۔
